TERMS OF SERVICE

1. Acceptance of These Terms

By creating an account, downloading, installing, or using ‘Scape,’ visiting any Real Lies-controlled website, or otherwise accessing our services (collectively, the “Service”), you (“you” or “User”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not access or use the Service.

2. Relationship to Other Documents

These Terms incorporate by reference—and do not replace—our End-User License Agreement (EULA) and Privacy Policy. If a conflict exists, the documents govern in the following order: (a) EULA (software license provisions), (b) these Terms, and (c) Privacy Policy (data-handling obligations).

3. Eligibility & Accounts

  1. Age. You must be at least 13 years old (16 in the EEA/UK) or the minimum digital-consent age in your jurisdiction.

  2. Account Information. You agree to provide accurate, complete, and up-to-date information and to keep it current.

  3. Credentials. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

4. License to Use the Service

Subject to continuous compliance with these Terms, Real Lies Corp. (“Real Lies,” “we,” “our,” or “us”) grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Service for personal, non-commercial purposes in accordance with the EULA.

5. Fees, Subscriptions & Virtual Items

  1. Purchases. Certain features, in-app purchases, or subscription tiers may require payment. Prices and currency are displayed before checkout and are subject to change.

  2. Billing. By completing a transaction, you authorize Real Lies and its payment processors to charge your selected payment method.

  3. Renewals & Cancellations. Subscriptions renew automatically at the then-current rate unless cancelled at least 24 hours before the end of the current period through your platform’s subscription-management interface.

  4. Virtual Items. Any virtual credits, tokens, or digital goods have no real-world monetary value, are licensed—not sold—and are non-refundable except where required by law.

6. User Content

  1. Ownership. You retain all rights in content you upload, stream, or otherwise make available through the Service (“User Content”).

  2. License to Us. You grant Real Lies a worldwide, royalty-free, sublicensable license to host, store, reproduce, modify (solely for technical purposes), distribute, publicly perform, and display User Content within or to promote the Service, subject to your privacy settings.

  3. Community Guidelines. You will not post content that is illegal, infringing, hateful, harassing, or otherwise violates our Community Guidelines. We may remove or disable access to any User Content at our sole discretion.

7. Prohibited Conduct

You agree not to:

  • Access or use the Service for any unlawful or fraudulent purpose.

  • Upload viruses, malware, or code intended to disrupt or compromise the Service.

  • Reverse-engineer, decompile, or attempt to derive the source code except as expressly permitted by law.

  • Circumvent security or access controls.

  • Engage in data scraping, bulk collection, or automated harvesting of content or user information.

  • Use the Service to build or promote a competing product or service.

8. Beta Features & Feedback

We may release new, experimental, or beta features (“Beta Features”). Beta Features are provided “as is” without warranties and may be modified or discontinued at any time. You grant Real Lies a royalty-free license to use any feedback, suggestions, or ideas you provide without compensation or attribution.

9. Third-Party Services & Links

The Service may link to or integrate with third-party services. Real Lies is not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

10. Termination & Suspension

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, the EULA, or applicable law. Upon termination, the licenses granted to you end immediately, and you must cease all use of the Service. Sections 6 (license to User Content), 11–15, and any payment obligations survive termination.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. USE IS AT YOUR SOLE RISK, AND YOU ASSUME ALL RESPONSIBILITY FOR ANY DAMAGE TO YOUR DEVICES OR DATA.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REAL LIES, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR LICENSORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR OTHER INTANGIBLE LOSSES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED US $50 OR THE AMOUNT YOU PAID TO USE THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

13. Indemnification

You agree to defend, indemnify, and hold harmless Real Lies and its affiliates from any claims, damages, liabilities, and costs (including reasonable attorneys’ fees) arising from your breach of these Terms, your User Content, or your misuse of the Service.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles.

  • Informal Resolution. Contact us first to attempt informal resolution (legal@realliescorp.com).

  • Arbitration (U.S. Users). Except for claims eligible for small-claims court, any dispute that cannot be resolved informally shall be finally resolved by binding arbitration in Los Angeles County, California, administered by the American Arbitration Association under its Consumer Arbitration Rules.

  • Opt-Out. You may opt-out of arbitration by sending a written notice to legal@realliescorp.com within 30 days of first accepting these Terms.

  • No Class Actions. Disputes will be resolved only on an individual basis; class actions and class-wide arbitrations are not permitted.

15. International Users

If you access the Service from outside the United States, you are responsible for compliance with local laws. We make no representations that the Service is appropriate or available in other jurisdictions.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notice or email at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance.

17. Miscellaneous

  • Severability. If any provision is held unenforceable, the remainder remains in force.

  • No Waiver. Our failure to enforce any right is not a waiver.

  • Assignment. We may assign these Terms without restriction; you may not assign them without our prior written consent.

  • Entire Agreement. These Terms, together with the EULA, Privacy Policy, and any additional terms integrated herein, constitute the entire agreement between you and Real Lies regarding the Service.
